Legal situation – When booking a hotel room

§1 If a hotel room is ordered, confirmed or made available at short notice, a guest accommodation contract is concluded.
§2 The conclusion of the guest accommodation contract obliges the contracting parties to fulfil the mutual obligations arising from it for the entire duration of the contract.
It is the innkeeper's obligation to keep the room ready according to the order.
The guest is obliged to pay the price for the time (duration) of the hotel room reservation.
§3 If a guest does not use the booked hotel room, he can cancel it free of charge 7 days before arrival. After that, a cancellation fee of 80% will be charged.
§6 The innkeeper is entitled to cash payment for all services before departure and accordingly has a legal lien on the items brought in by the guest.
§7 The place of jurisdiction is the location of the business, since even if the room is not used, the services arising from the guest accommodation contract must be provided at the location of the business.
Separate in-house terms and conditions
§8 If you book more than two rooms, we ask that you cancel 14 days before arrival. If you cancel later or do not arrive without prior cancellation, we will charge 80% of the invoice amount if the rooms are not rented out to someone else.
§9 If smoking occurs in one of our hotel rooms, we reserve the right to charge the costs for 2 additional days.
In case of early departure we charge 80% of the remaining booking amount
on the total amount, unless we are able to rent the contingents to someone else.
